Data privacy statement of Beurer GmbH

Beurer GmbH takes data protection seriously and in this data privacy statement, we would like to explain to you which data is absolutely necessary, how we use your data and how you can correct or change your details. In our opinion, protection of your privacy is a top priority, which is why we consider compliance with the strict legal data protection regulations to be a matter of course. We are absolutely convinced that data protection starts with transparency. We have therefore made it our objective to make sure you always know when we store which particular aspects of your personal data, how we use it and also how you can restrict its use or even prevent it from being used at all.

The operator of the website www.beurer.com and of the Beurer apps “Beurer Health Manager”, “Beurer RecipeScale”, “Beurer BodyShape”, “Beurer MyIPL”, “Beurer LightUp” and thus the service provider in the meaning of the German Telemedia Act (TMG) and the responsible body in the meaning of German Federal Data Protection Act (BDSG) is Beurer GmbH, Ulm.

By using our website and our apps, which are available on iTunes, Google Play or through our website, you consent to the collection, processing and use of your personal data by us, in agreement with this data privacy statement and the legal provisions. You have the right to revoke your consent at any time for the future.

1. What is personal data?

Personal data includes all information about the personal and material circumstances of a certain or determinable individual person. This includes information and details such as your (real) name, your home address or other address and telephone number. Your e-mail address also forms part of the information if it relates to your name and makes you identifiable. Information that cannot be used to determine your identity is not part of your personal data. Such information includes, for example, all details without any relation to your name, e.g. only the specification of your gender, your age or your education.

2. Use and disclosure of personal data

Beurer GmbH undertakes to protect your privacy and only uses your personal information within the company and only discloses such information to companies that are involved in the performance of contracts that have been concluded with you or companies that are otherwise involved in the service provision. Apart from these instances, your personal details are not disclosed to third parties unless you have expressly given your consent to this or if we are obligated to release the information, for example due to a legal or official order.

3. Use of our Beurer apps

When you download and use our apps, Beurer will collect, process and use additional data.

a. Downloading the app
When you download the app, the necessary information will be transferred to the App Store/Play Store, including, in particular, the e-mail address and password for your account, the time of the download, payment information and the individual device code. Beurer has no influence on this data collection. Without your explicit consent or without legal basis, your personal data will not be passed on to third parties not involved in contract processing

b. Use of the app
We will collect further personal data during your use of the app. We will only use your personal data (e-mail address, surname, first name, date of birth, gender, height, health and nutrition data in the app) in accordance with the provisions of German Data Protection Law. The following provisions inform you about the nature, scope and purpose of the collection, processing and use of personal data. This data privacy statement relates only to the specified offer. If you are redirected to other offers via links, please check the respective handling of your personal data there.

c. Purpose of the use of personal data
To enable us to provide user-friendly, efficient and secure Internet services, we are dependent upon the use of your personal data. Beurer therefore collects, processes and uses personal data

  • to provide the services desired by you, in particular to support you with improved planning and monitoring of training and health management;
  • to inform you about changes to our services;
  • to inform you about offers, such as new Beurer products and updates, provided you have granted separate consent in appropriate advertising or the requirements of Section 7(3) of the Federal Law on Unfair Competition (UWG) are met.

d. Mandatory user details in the app
The “E-mail address” and “Password” are mandatory details used to identify the user and for communication between the provider and the user. The user's e-mail address and all other user data cannot be accessed by other users.

e. Data collection for analysis purposes
For the purposes of identifying and tracking misuse, analysing technical problems and evaluating the server load, data server log files are created, saved and evaluated as required.

f. Technical backup copies
To protect the data stock for the offer, regular backups are created. This data will only be used to restore the data stock in the event of the loss of data.

g. Apple Health
The Beurer app allows you to connect and share Beurer app data with the Apple Health app and vice versa. Apple's General Terms and Conditions as well as the Apple Data Privacy Policy apply to the information and data that you provide to Apple Health and must therefore be observed.

The information that you send from the Apple Health app to Beurer will not be used by Beurer for marketing or advertising purposes, nor will it be passed on to third parties without your consent.

4. Establishing contact

When establishing contact with us (for example, by contact form or e-mail), the user's details are stored for the purposes of processing the enquiry and for the eventuality that subsequent questions arise, provided that these are required for processing.

5. Newsletter

Our free newsletter informs you about updates to our products and special product offers.
If you would like to receive the newsletter, we require a valid e-mail address from you as well as information that allows us to check that you are the owner of the specified e-mail address or that the owner of the e-mail address consents to receiving the newsletter. No further data is collected. This data is only used to send the newsletter and is not disclosed to third parties.
If you have registered for a Beurer newsletter, Beurer GmbH will deliver the Beurer newsletter using the data you provided during registration. Your data is not disclosed to third parties. The only exceptions to this are the partner companies that are responsible for the technical processing involved in sending the newsletter. However, in such cases, the scope of the disclosed data is limited to the absolute minimum amount of data required. Our data protection provisions conform to the German Federal Data Protection Act (Bundesdatenschutzgesetz; BDSG) and the German Telemedia Act (Telemediengesetz; TMG).
When you register for the newsletter, we store your IP address and the date of registration. This data is stored exclusively to serve as proof in the event that a third party misuses an e-mail address and registers to receive the newsletter without the knowledge of the authorised party.
You can withdraw your consent to the storage of the data, the e-mail address and their use for dispatch of the newsletter at any time. Permission can be revoked via a link specified in the newsletter itself, in your profile or by sending a notification to the contact options given in paragraph 8.

6. Use of cookies

Cookies are text files that contain information to identify returning visitors exclusively for the duration of the visit to our website. Cookies are stored on the hard drive of your computer, where they do not cause any damage. The cookies from our Internet pages do not contain any personal data about you.
Cookies save you from entering data repeatedly, make it easier for you to transmit specific contents and help us to identify the particularly popular areas of our website. This enables us to adapt the content of our website to precisely meet your requirements.

7. Data collection through the use of Google Analytics

According to the data protection policy and information from Google, this concerns text files that are stored on your computer and facilitate analysis of your use of the website. Google uses the DoubleClick DART cookie

No directly personal user data is stored, only the Internet Protocol address. This information enables us to recognise you automatically the next time you visit our website and to make navigation easier for you. For example, cookies allow us to adapt a website to your interests or to save your password so that you do not have to enter it every time.

It goes without saying that you can also view our website without cookies. 8. Collection and storage of usage data

To optimise our website, we collect and store data such as the date and time the page was called up, the page from which you called up our page and similar data. This is done anonymously, i.e. without personally identifying the user of the site. If relevant, user profiles are created by means of a pseudonym. In this case, too, there is no connection between the natural person the pseudonym stands for and the collected usage data. We also use cookies to collect and store usage data. These are small text files that are stored on your computer and serve to store statistical information such as your operating system, browser, IP address, the previous website you visited (referral URL) and the time. We collect this data exclusively for statistical purposes to further optimise our website and to be able to make our Internet offering even more attractive. At any time and free of charge, you may request immediate information about the data stored about you as a person or about a user name assigned to you. 10. Social plugins

On our website you will see to some extent so-called "social plugins". These are functions of the respective social networks that you can use to share content from our website with your friends on social networks for example or to recommend this content more widely. If you are not a Facebook member, it is still possible for Facebook to find out and store your IP address.

Beurer is never informed which Facebook buttons you have used or when you have used them. Instead it only receives a summarised, non-personalised statistic on the use of the Beurer Facebook page and a summarised statistic on the use of the Facebook buttons in relation to Beurer. Google+
A Google+ button for the social network "Google+" is connected to much Beurer content. This social network is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. The Google+ button is identified by the "+1" symbol.

If you use Beurer services, e.g. you open one of our web pages that contains a Google+ button, your browser establishes a direct connection with Google servers and the button is loaded from there. In this way the information that the corresponding pages on our website have been opened is sent to Google Inc.
The content of the "+1" button is transferred by Google directly to your browser and integrated by it into the website. We therefore have no influence over the extent of the data which Google obtains using this button. According to Google no personal data is collected if the button is not clicked. Data, including IP addresses, is only collected and processed for logged-in members of the Google+ social network.

If you are a Google+ member and do not wish Google to collect data about you via our Internet site, you must log out of Google+ before visiting our Internet site.
Beurer is never informed if or when you have used the Google+ button. Instead it only receives a summarised, non-personalised statistic on the use of the Google+ button from Google.
